1. About GatherGift

GatherGift ("we", "us", "our") is an Australian-based platform that allows parents and organisers ("Recipients") to create shareable gift pages for celebrations. We provide integrated payment processing services through our partner, Stripe, to facilitate contributions from family and friends ("Contributors") toward a group gift.

Payments on the platform are processed exclusively through Stripe Connected Accounts. Each Recipient connects their own Stripe account to their GatherGift page, and contributions from Contributors are charged directly through Stripe to that connected account. GatherGift facilitates this connection. GatherGift does not charge any mandatory per-transaction fee — the full gift amount chosen by the Contributor is routed to the Recipient. When a Contributor makes a contribution, they have the option to add a small tip to GatherGift and/or a charity donation on top of their gift. These are entirely optional and always the Contributor's choice. Tips are a meaningful way for Contributors to help keep GatherGift free for the families who use it — every tip, however small, helps us continue building a simple, joyful way to celebrate the kids in their community. When chosen, these amounts are retained by GatherGift to support the platform and our chosen charity partners.

2. Acceptance of terms

By accessing or using GatherGift, you confirm that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, please do not use the platform.

You must be at least 18 years of age to create a GatherGift account or use the platform as a Recipient.

3. User roles

The platform has two user roles:

• Recipient: A registered user who creates and manages a GatherGift page, including uploading content and connecting a Stripe Connected Account to receive contributions.
• Contributor: A person who views a GatherGift page via a shared link and may choose to make a contribution through the platform's Stripe-powered checkout, with or without a registered GatherGift account.

4. Recipient responsibilities

As a Recipient, you agree to:

• Provide accurate and honest information on your GatherGift page.
• Complete Stripe Connected Account onboarding through the platform and maintain your Stripe account in good standing. You authorise GatherGift to use your connected account to process contributions. Where a Contributor chooses to add an optional tip or charity donation on top of their gift, you authorise GatherGift to retain those optional amounts; no fee is deducted from the gift amount itself.
• Keep your Stripe account details, including bank account and identity information, accurate and up to date.
• Not use the platform for any fraudulent, deceptive, or unlawful purpose.
• Not impersonate any person or misrepresent your identity.
• Ensure any content you upload, including photos, does not infringe third-party intellectual property rights and does not depict minors in any inappropriate way.
• Comply with all applicable Australian laws, including consumer protection laws under the Australian Consumer Law.
• Comply with the Stripe Connected Account Agreement and all other Stripe terms that apply to your account.

You are solely responsible for the accuracy of the information you provide to Stripe during onboarding and for keeping your connected account active and verified. GatherGift has no ability to assist with, recover, or resolve issues relating to the internal status of your Stripe account beyond initiating onboarding from the platform.

5. Financial Terms, Payment Processing, and Fees

When a Contributor makes a contribution via the GatherGift platform, the funds are processed securely through Stripe using the Recipient's connected Stripe account. GatherGift uses Stripe's destination charge model so that the gift amount is routed directly to the Recipient's connected account, while any optional tip, optional charity donation, and the estimated card-processing fee the Contributor pays at checkout are retained by GatherGift to support the platform and cover Stripe's processing cost.

Platform Service Fee: Each contribution may include an optional tip to GatherGift and an optional charity donation, chosen by the Contributor at checkout. These optional amounts, together with the estimated card-processing fee the Contributor pays at checkout, are retained by GatherGift to help keep the platform free for families and to cover Stripe's card-processing cost. Stripe applies its own processing fee to each transaction, which is deducted from what GatherGift retains — it is never added on top or charged to the Recipient.

Processing Fees: Stripe applies a card-processing fee to every transaction. At GatherGift, this fee is paid by the Contributor at checkout — it is added to the contribution as a separate line item and never comes out of the gift amount. GatherGift bears any variance between the estimated fee shown at checkout and the actual fee Stripe charges, so the Recipient is never asked to cover it.

What You Receive: The full amount that Contributors choose to give as a gift (the "gift amount") is routed to your connected Stripe account and belongs solely to you. GatherGift does not take any portion of this gift amount, and no Stripe processing fee is deducted from it. The only amounts not routed to you are the optional tip, the optional charity donation, and the estimated card-processing fee that a Contributor pays at checkout — these are retained by GatherGift to support the platform and cover Stripe's processing cost. When you withdraw your funds, the bank transfer to your nominated account is free — GatherGift and Stripe do not charge you to move your own money.

Non-Custodial Platform: GatherGift is a non-custodial platform. We do not hold, pool, or custody contributor funds at any time. All contributions are processed directly by Stripe and are settled immediately into the Recipient's own connected Stripe account. GatherGift has no legal or technical ability to access, withdraw, or redirect the gift amounts collected by a Recipient.

Data Security: GatherGift does not collect, process, or store sensitive credit card or banking information. All payment data is handled exclusively by Stripe, which is certified to PCI-DSS Level 1 — the highest level of certification available in the payments industry. By using the platform, you acknowledge that your payment information is submitted directly to Stripe and is governed by Stripe's own privacy and security policies.

No Mandatory Fee: GatherGift does not charge any mandatory per-transaction fee on contributions. The full gift amount chosen by a Contributor is always routed to the Recipient. We keep the platform free for families by relying on the optional tips and charity donations that Contributors choose to add at checkout — there is never any obligation to give one. If you'd like to support the families in our community, adding a small tip when you contribute is a wonderful way to help us keep GatherGift simple, joyful, and free to use. Should GatherGift ever introduce a mandatory fee in the future, we commit to being fully transparent: any such fee will be clearly displayed as a separate line item during the contribution checkout process, allowing Contributors to see exactly how much of their gift goes to the Recipient versus the platform before they confirm their contribution.

Payout Responsibility: Recipients request payouts through the platform, and Stripe transfers the available balance from the connected account to the Recipient's nominated bank account. Funds routed to your connected Stripe account are held and managed by Stripe until you initiate a payout to your bank account. While we strive to ensure a smooth transfer of funds, GatherGift is not a bank or financial institution. We are not liable for any delays in payout processing caused by Stripe, banking institutions, or any issues related to the Recipient's connected Stripe account status.

6. Refunds

Contributions made through GatherGift are generally non-refundable once the contribution has been completed. If you believe a contribution was made in error, please contact us at gathergift.au@gmail.com within 48 hours of the transaction. Refunds cannot be issued after the funds have been withdrawn (paid out) to the gift recipient's bank account, as GatherGift is a non-custodial platform and does not hold or control contributor funds once they have been paid out.

Please note that any optional charity donation included with your contribution is non-refundable. These donations are forwarded to our charity partners to support children in need, and once processed they cannot be reversed.

7. Stripe Connected Accounts

Recipients must connect a Stripe account to their GatherGift page to receive contributions. By connecting a Stripe account, you agree to Stripe's terms of service, including the Stripe Connected Account Agreement, and you authorise GatherGift to process contributions on your behalf through that account.

GatherGift is a non-custodial platform. We do not hold, pool, or custody contributor funds at any time. All funds are processed directly by Stripe and settled immediately to the Recipient's connected account. GatherGift has no legal or technical ability to access, withdraw, or redirect the gift amounts collected by a Recipient. Our role is limited to facilitating the connection between Contributors and Recipients and applying the platform service fee described in Section 5.

If a Recipient's Stripe account becomes inactive, unverified, or otherwise unavailable, GatherGift may pause the ability to accept contributions on the affected gift page until the account is restored.

8. Prohibited conduct

You must not use GatherGift to:

• Engage in fraud, scams, or misrepresentation, including using a Stripe connected account for any purpose other than the stated purpose of the gift page.
• Collect funds for purposes other than those stated on the gift page.
• Upload or share content that is defamatory, offensive, harassing, or unlawful.
• Upload content that identifies or depicts minors in a way that could compromise their safety or privacy.
• Attempt to gain unauthorised access to any part of the platform or another user's account.
• Use automated tools to scrape, crawl, or collect data from the platform.

9. Intellectual property

All intellectual property in the GatherGift platform, including its design, code, branding, and content (excluding content submitted by users), is owned by or licensed to GatherGift.

By uploading content to the platform, you grant GatherGift a non-exclusive, royalty-free licence to display that content solely for the purpose of operating the platform. You retain ownership of your content.

10. Disclaimer of warranties

GatherGift is provided on an "as is" and "as available" basis. To the maximum extent permitted by Australian law, we make no warranties, express or implied, regarding the platform's availability, accuracy, or fitness for a particular purpose, including no warranty regarding the availability, security, or performance of Stripe or any connected Stripe account.

Nothing in these terms excludes any guarantee or right you may have under the Australian Consumer Law that cannot be excluded by law.

11. Limitation of liability

To the maximum extent permitted by law, GatherGift's total liability to any user for any claim arising out of or relating to these terms or the platform will not exceed AUD $100.

GatherGift is not liable for any indirect, incidental, special, or consequential loss, including loss of funds, data, or revenue, arising from your use of the platform or from any transaction processed through Stripe.

12. Termination

We reserve the right to suspend or terminate any account or remove any GatherGift page at our sole discretion, without notice, if we reasonably believe a user has breached these terms or is using the platform unlawfully.

You may delete your account at any time by contacting us at gathergift.au@gmail.com.

13. Changes to these terms

We may update these Terms of Service from time to time. Where changes are material, we will notify registered users by email or via a notice on the platform. Continued use of the platform after changes take effect constitutes your acceptance of the updated terms.

14. Governing law

These terms are governed by the laws of New South Wales, Australia. You agree to submit to the exclusive jurisdiction of the courts of New South Wales for any dispute arising from these terms or your use of the platform.
